Terms & Conditions

Introduction

These Terms & Conditions (“T&Cs”) apply to all orders placed with Sunny Platters (“we”, “us”, “our”). By placing an order, you agree to these T&Cs, including our Refund & Cancellation Policy, Delivery Terms, Allergen Disclaimer, and Privacy Practices. Please read these T&Cs carefully before placing an order. By submitting an order, you confirm that you have read, understood, and accepted these policies.

1. Ordering & Payment

​Orders must be placed via our order form. An invoice will be issued, and full payment via direct bank transfer is required to secure your order. Orders are only confirmed once payment is received. We do not store banking details and are not responsible for errors, delays, or data breaches through your bank or online banking.​​

2. Pricing & Taxes

​All prices exclude GST, which will be added to your invoice. Prices may change without notice. Additional delivery fees may apply for locations beyond 30km from South Morang, and any extra costs are the customer’s responsibility.​​

3. Refund & Cancellation Policy

Orders must be placed at least 72 hours (3 days) before delivery. Each platter is freshly prepared with high-quality ingredients and is best enjoyed on the day of delivery. No refunds or exchanges are available for change of mind, incorrect orders, or late consumption. Cancellations made more than 72 hours before delivery may be rescheduled or credited; cancellations within 72 hours are final.

For issues such as missing items, incorrect platters, or quality concerns, you must contact us within 1 hour of delivery with clear photos. We take timestamped photos of all platters prior to delivery for verification. Confirmed faults may be remedied with a credit note, separate from change-of-mind cancellations.​

4. Faulty or Missing Items

If there’s an issue with your order (e.g., missing items, incorrect platter, or quality concerns), please contact us within 1 hour of delivery. Clear photos of the platter must be provided so we can assess the situation. We take timestamped photos of all platters prior to delivery to ensure quality and presentation. If a fault is confirmed, we will provide an appropriate remedy, which may include a partial refund, replacement, or credit note, at our discretion. Remedies for faulty or unsafe products are separate from change-of-mind cancellations.

5. Delivery & Handling

​We deliver across Melbourne and surrounding areas, with free delivery within 30km of our preparation location. (additional fees may apply beyond this radius). There is no pick-up option, and deliveries start from 10:00 am daily. Platters are perishable, freshly prepared, and best enjoyed on the day of delivery. Each serves approximately 5-8+ people, and storage and serving instructions are provided on delivery. Once a platter leaves our care, Sunny Platters is not responsible for how it is handled, transported, stored, or served.​

6. Packaging, Presentation & Liability

​Platters are delivered in protective packaging to maintain presentation, though variations may occur due to seasonal ingredients or transport. We are not liable for personal injury, allergic reactions, or damage resulting from mishandling or failure to follow storage or serving instructions. Please ensure all food remains on the provided food-safe paper.

7. Allergen Disclaimer

We do not cater for food allergies or specific dietary requirements. Platters are prepared in a small kitchen containing all major allergens, including gluten, dairy, eggs, peanuts, tree nuts, soy, sesame, fish, crustacea, molluscs, and lupin. By placing an order, you acknowledge these allergens may be present and accept the risk. Please enjoy our platters responsibly and at your discretion.

8. Intellectual Property

​All images, branding, and content of Sunny Platters are our intellectual property. You may not copy, reproduce, or distribute them without written consent. We may share platter images across social media, digital, and print platforms.

9. Customer Responsibilities

Customers must provide accurate delivery details, including address, contact information, and any relevant instructions. We are not responsible for missed or delayed deliveries due to incorrect or incomplete information. It is the customer’s responsibility to ensure someone is available to receive the platter during the scheduled delivery window. If no one is available, the platter will be left in a safe place as instructed, or, if no instructions are provided, in a location we deem reasonably safe. Once left, we take no responsibility for the platter or its condition, including damage, spoilage, or loss.

10. Force Majeure

We are not liable for delays, changes, or cancellations caused by events beyond our control, including severe weather, traffic, illness, public holidays, or other unforeseen circumstances.

11. Communication & Marketing Consent

​By placing an order, you agree to receive order updates, administrative messages, and occasional promotional communications via email, SMS, or social media. You may unsubscribe from marketing messages at any time using the opt-out option.

12. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia, and any disputes will be handled under local jurisdiction.

13. Acceptance of Terms

Before completing your order, you will be asked to confirm:
“I have read, understood, and accepted the Terms & Conditions, Refund & Cancellation Policy, and Allergen Disclaimer.”

By placing an order, you acknowledge that you have read and agreed to these terms in full.
